Netherlands’ Role as F-35 Hub Under Fire in Supreme Court Case

The Netherlands’ strategic role as a major hub for F-35 fighter jet parts is under intense legal scrutiny, with the Supreme Court set to rule on a ban on shipments to Israel. The case challenges the government’s policy of allowing U.S.-owned military hardware to be transferred from its territory to an active conflict zone.
The legal action, brought by human rights advocates, argues that the Netherlands cannot turn a blind eye to how these parts are being used. They contend that by acting as a transit point, the country is facilitating Israel’s war in Gaza, which they allege involves war crimes. Israel denies these claims.
An appeals court decision in February 2024 brought the issue to a critical juncture by ordering a halt to the exports. The court found that the potential for the parts to be used in violations of international law was too significant to permit their continued transfer. The government’s appeal places this finding at the center of the Supreme Court’s deliberations.
The government’s defense highlights its position as a logistical partner to the United States. It argues that interfering with the flow of U.S.-owned parts would undermine its reliability as an ally and that, in any case, the U.S. would find other ways to supply Israel. This pragmatic view is at odds with the rights-based argument of the plaintiffs.
The court’s ruling will have significant consequences, not just for the Gaza conflict but also for the future of the F-35 program’s logistics in Europe. The war, which began on October 7, 2023, has already prompted several European countries to reconsider their military trade with Israel, making the Dutch decision a key indicator of the continent’s stance.
